Article 1 – Available payment methods
- During checkout, the payment methods that are available for the United Kingdom and for the order in question are displayed. Depending on the country, the order amount and the order, the following payment methods, among others, may be offered:
- iDEAL | Wero;
- PayPal;
- Bancontact;
- credit card;
- SEPA bank transfer;
- Belfius;
- Klarna;
- Riverty;
- Google Pay.
- Not every payment method is available for every order in the United Kingdom. If a payment method is not displayed during checkout, it cannot be used for the order in question. The payment methods visible at checkout are decisive.
- For pay later via Klarna, Riverty or another payment service provider, the acceptance criteria and terms of the provider concerned also apply. The payment service provider may independently accept or refuse a payment request.
- Payments are processed via the secure payment environment of the payment service provider concerned.
Article 2 – Obligation to pay
- By completing the order via a button that clearly indicates that an obligation to pay arises, the customer undertakes to pay the total amount stated during checkout, subject to final acceptance of the order by ReMarkt.
- With a direct payment method, the order is processed after the payment has been successfully completed and confirmed by the payment service provider.
- With a SEPA bank transfer, processing begins once the full amount has been received by ReMarkt. Processing a bank transfer can take several working days and may therefore affect the expected dispatch date.
- With pay later via Klarna, Riverty or another payment service provider, the order may be processed as soon as the payment service provider has approved the payment. The customer then pays within the period and in accordance with the terms of the payment service provider concerned.
- The consumer pays according to the payment method chosen during checkout. Advance payment is only requested to the extent permitted under the mandatory law of the United Kingdom.
- If a payment has not been successfully completed or the chosen payment method is not approved, ReMarkt is not required to process or deliver the order. This does not apply where a different payment term has been agreed in writing.
- A payment confirmation does not automatically mean that the order has been finally accepted by ReMarkt. The terms and conditions apply to the formation of the contract.
Article 3 – Prices and VAT
- The prices displayed to consumers with a delivery address in the United Kingdom state which VAT and other known taxes are charged by ReMarkt. Import VAT, customs duties and customs clearance charges may be payable separately on import.
- Prices for business customers may be displayed exclusive of VAT, provided this is clearly indicated in advance.
- Before the order is completed, the full total amount is displayed in the currency of the website or checkout used. This amount includes all taxes charged by ReMarkt and all known shipping, payment, configuration and other additional costs. If the bank or card issuer converts the amount into another currency, the exchange rate and any conversion charges are determined by that party.
- ReMarkt may change prices and offers. A price change does not affect an order that has already been finally accepted by ReMarkt.
- Obvious pricing errors or mistakes are not binding where the customer should reasonably have understood that the displayed price was incorrect. ReMarkt will inform the customer of this before the order is finally accepted. The customer is not obliged to accept an order at an adjusted price.
- For an export delivery from the Netherlands to the United Kingdom, ReMarkt may apply the 0% VAT rate where the statutory conditions are met and the export can be evidenced.
- Depending on the value and nature of the order, UK VAT may be charged during checkout or levied on import. Customs duties and customs clearance charges are payable by the recipient unless it is expressly stated that ReMarkt collects these amounts.
- The customer provides the information reasonably required for export, import and customs clearance. The tax treatment and amounts shown during checkout and on the invoice are decisive. A different tax treatment may apply to Northern Ireland and other special customs territories.
Article 4 – Payment method charges
- Any charges for using a payment method are clearly stated before the order is completed and are included in the total amount.
- ReMarkt does not charge payment fees where the mandatory law of the United Kingdom prohibits this.
- Where a surcharge is legally permitted, it never exceeds the actual direct costs that ReMarkt pays for the use of the payment method concerned, and it is stated before the order is completed.
- If no additional payment charges are stated during checkout, no separate charges will be made for this.
Article 5 – Processing and confirmation of payments
- After a successful payment or approval of the chosen payment method, the customer receives a confirmation of this by e-mail.
- The invoice is sent by e-mail together with the payment confirmation. In addition, a paper invoice is included with the parcel and, where this function is available, the invoice is placed in the customer account.
- The processing time of the order begins once ReMarkt has accepted the order and the payment or chosen payment method has been approved.
- With a SEPA bank transfer, processing can take several working days. The order is only released for further processing once ReMarkt has received the amount and has been able to match it to the correct order.
- When making a bank transfer, the customer must quote the correct order number or payment reference. A missing or incorrect reference may delay the matching and processing of the payment.
- The processing time of a bank or payment service provider is outside ReMarkt's direct control. ReMarkt nevertheless remains responsible for correct processing once the payment has been received or confirmed by ReMarkt.
Article 6 – Retention of title
- To the extent permitted by law, delivered products remain the property of ReMarkt until the full amount owed for these products and the associated contract has been paid in full and finally.
- As long as ownership has not yet passed to the customer, the customer may use the product normally. The product may not be sold, pledged, hired out, transferred or otherwise encumbered without the prior written consent of ReMarkt.
- If a third party makes a claim to a product that is still the property of ReMarkt, or if such a product is seized, the customer must inform ReMarkt of this as soon as possible.
- If the customer fails to meet a payment obligation that has fallen due and is in default following a valid reminder, ReMarkt may reclaim the product, with due regard for the customer's statutory rights.
- Where payment is made via Klarna, Riverty or another pay later service, the payment to ReMarkt is deemed to have been made as soon as the payment service provider has finally executed or guaranteed the payment to ReMarkt. The customer's payment obligation towards the payment service provider continues to exist in accordance with the terms of that payment service provider.
Article 7 – Late payment and collection costs
- The customer must pay the amount owed within the period stated during ordering, on the invoice or in a separate agreement.
- If a consumer in the United Kingdom does not pay on time, ReMarkt first applies every free-of-charge payment reminder, formal notice or additional payment period that is required under the mandatory law of the United Kingdom.
- After that period has expired, only the statutory interest and recovery costs that are permitted under the law of the United Kingdom, and that have been validly agreed in advance where this is required, may be charged.
- ReMarkt never charges more interest or recovery costs than is permitted under the mandatory law of the United Kingdom.
- With pay later via Klarna, Riverty or another payment service provider, payment, payment reminders and any additional charges are handled by the payment service provider concerned. The terms of that payment service provider and the applicable statutory rules apply to this.
- For a business customer, after the agreed payment period has expired, the rules on default, commercial interest and recovery costs that apply under the contract and the applicable law apply. ReMarkt only charges reasonable and legally permitted amounts.
- ReMarkt may transfer a due and unpaid claim to a debt collection service provider or another authorised third party.
Article 8 – Failed or unapproved payments
- If a payment is cancelled, fails or is not approved by the payment service provider, the order is not released for further processing.
- Where the payment service provider offers this option, the customer receives a notification that the payment has not been successfully completed.
- The customer can make the payment again or choose another available payment method.
- If Klarna, Riverty or another pay later service refuses a payment request, ReMarkt cannot change this decision independently. In that case, the customer can use another available payment method.
- With some payment methods, an amount may be temporarily reserved on the customer's account or credit card, even if the payment is ultimately not completed. The bank or payment service provider determines when this reservation is released.
- Has the amount been debited according to the customer, but does the order remain registered as unpaid? Then the customer can contact customer service and include the order number and proof of payment. ReMarkt will then check whether the payment can be matched.
- If a payment has demonstrably been made twice, ReMarkt will refund the excess amount received, after verification, without undue delay.
- If an order remains unpaid or the chosen payment method is not approved, ReMarkt may cancel the order after a reasonable period. A product is only made available again once it has been established that no valid payment is still expected.
Article 9 – Fraud and misuse
- ReMarkt and the payment service providers involved may check payments and orders in order to prevent fraud, misuse and unauthorised transactions.
- Where there are objective indications of fraud, misuse or an unauthorised payment, ReMarkt may temporarily suspend the processing of the order and request additional verification.
- ReMarkt only requests information that is reasonably necessary to verify the identity of the customer, the payment or the accuracy of the order. This information is processed in accordance with ReMarkt's privacy policy.
- ReMarkt may refuse an order before final acceptance if the payment cannot be reliably confirmed, the information provided cannot be verified, or another legally permitted ground for refusal exists.
- If the customer does not cooperate with a necessary verification request within a reasonable period, ReMarkt may refuse or cancel the order, to the extent permitted by law.
- If the contract has already been formed, ReMarkt may only suspend performance or terminate the contract where there is a statutory or contractual ground for doing so.
- In the event of refusal or cancellation, a payment received is refunded via the original payment method, unless the payment service provider itself blocks or reverses the payment, or the law precludes a refund.
- ReMarkt may report a suspicion of fraud or misuse to the payment service provider involved or to the competent authorities where this is legally permitted or required. The customer will be informed of this to the extent that this is legally possible and does not obstruct the investigation.
Article 10 – Refunds
- If an order is refused before final acceptance by ReMarkt or cannot be fulfilled, ReMarkt will refund any amount already received without undue delay.
- In the event of full cancellation, ReMarkt refunds all payments received from the consumer, including the cost of the cheapest standard delivery offered by ReMarkt.
- If the consumer chose a more expensive shipping method for the original order, only the amount of the cheapest standard delivery offered is refunded.
- In the event of partial cancellation or a partial return, the original shipping costs are not refunded, unless the law or a separate agreement provides otherwise.
- ReMarkt makes any refund due as soon as possible and no later than fourteen days after receipt of the valid cancellation or return notification, unless mandatory law prescribes a shorter period.
- ReMarkt may withhold the refund until the product has been received or until the consumer has provided evidence that the product has been sent back, whichever is earlier.
- A product that is refused at the door or returned by the carrier after cancellation is first received and registered by ReMarkt via the regular returns process. The refund is then made in accordance with this article.
- The refund is made via the same payment method that was used for the order. A different payment method is only used with the consumer's consent and without additional costs.
- Where payment was made via Klarna, Riverty or another pay later service, ReMarkt reports the credit to the payment service provider concerned. An outstanding payment obligation is then adjusted or cancelled. If the invoice has already been paid, the refund is made via the payment service provider.
- The processing time of a bank or payment service provider may vary. ReMarkt remains responsible for making or reporting the refund on time, but has no direct control over the time the bank or payment service provider subsequently needs to make the amount visible.
- Any costs of returning the product and any demonstrable diminished value are handled in accordance with ReMarkt's terms and conditions and return conditions.
Article 11 – Disputing payments and chargebacks
- Objections to a payment can be reported to ReMarkt's customer service. This does not affect the customer's right to dispute a payment with the bank or payment service provider concerned.
- The terms and time limits of the bank or payment service provider concerned apply to a dispute or chargeback.
- ReMarkt may provide the payment service provider with the order, payment, shipping and delivery information necessary for handling the matter.
- A chargeback does not automatically terminate the purchase contract. If the contract has not been validly terminated, the obligation to pay may continue to exist.
- If the contract is terminated after the product has already been received, the product must be returned to ReMarkt in accordance with the return conditions.
- If a charged-back amount proves to be still owed, ReMarkt may demand payment again. Interest and collection costs are only charged to the extent permitted by law.
- In the event of demonstrable fraud or misuse, ReMarkt may subject future orders to additional checks or refuse them before final acceptance.
Article 12 – Payment security
- Payments are processed via the secure payment environment of the chosen payment service provider.
- The terms of the payment service provider concerned also apply to the technical processing and security of the payment.
- ReMarkt processes the available transaction data solely for the execution of the payment and the order, financial administration, fraud prevention and compliance with legal obligations. More information can be found in ReMarkt's privacy policy.
- Outside the secure payment environment, ReMarkt never asks for PIN codes, full login details for a bank account or security codes of a payment card.
- Have you received a suspicious payment request or a message about changed payment details? Then the customer should not make the payment and should first contact customer service using the contact details on the website.
- Any suspicion of misuse, phishing or an unauthorised payment must be reported as soon as possible to ReMarkt and to the bank or payment service provider concerned.
Article 13 – Applicability and contact
- These payment terms supplement the terms and conditions that apply to orders placed via www.remarkt.co.uk or with a delivery address in the United Kingdom. In the event of any discrepancy concerning a payment, these payment terms prevail, unless otherwise agreed in writing or mandatory law provides otherwise.
